  • CCP § 1161(2)

    The first step in a nonpayment eviction. The three days exclude Saturdays, Sundays, and court holidays, and the notice must state the exact rent owed and where and how to pay it.

    Served under CCP § 1162: personal delivery, then substituted service, then posting plus mailing when no suitable person is there.

Some cities, including Oakland, Berkeley, San Francisco, and Los Angeles, add their own notice rules, such as filing a copy with the rent board. Check your local ordinance before serving.

Posting is legal only in the right order.

CCP § 1162 lists three ways to serve a notice, and each one is allowed only when the one before it wasn’t possible. Our server works through them on the same trip.

  1. § 1162(a)(1)

    Personal delivery

    The notice is handed to the tenant. If they answer the door, this is where service ends.

  2. § 1162(a)(2)

    Substituted service

    If the tenant is absent, the notice is left with a person of suitable age and discretion at the home or workplace, and a copy is mailed.

  3. § 1162(a)(3)

    Post and mail

    If no suitable person is there, the notice is posted in a conspicuous place on the property and a copy is mailed to the tenant at that address.

Why the proof matters more in 2027

From January 1, 2027, AB 747 requires an eviction complaint to state the date, time, and location the notice was served, not just the method. Our proof gives you all three, backed by a photo stamped with GPS and time.

Posting without trying first

Taping a notice to the door is only valid after personal and substituted service were not possible. The attempt has to happen and be on record.

Skipping the mailing

A posted notice with no mailed copy is not complete service. It is the most common reason a notice-based eviction is thrown out.

Counting the wrong days

Three-day notices to pay or to cure exclude Saturdays, Sundays, and court holidays. File a day early and the case can be dismissed.
