When Same-Day Service Is Required
Same-day process serving isn't a premium add-on — it's what happens when the timeline compresses. Common scenarios we handle:
- Hearing scheduled for tomorrow or within 72 hours
- Temporary restraining order requiring immediate service
- Opposing counsel filed and your service clock is running
- Defendant's location confirmed — needs to be served before they move
- Emergency custody or family law matter
- Small claims hearing date approaching the service deadline
How Same-Day Service Works
- You call — provide the name, address, document type, and your deadline
- We verify — address confirmation before dispatch; we don't send a server to a dead address
- We dispatch — same-day, typically within 2–4 hours of confirmation
- We attempt — if defendant is absent on first attempt, we re-attempt same evening when possible
- We document — every attempt is GPS-timestamped and logged to court standard
- You confirm — notified immediately on completion; proof of service delivered digitally
Bay Area Same-Day Coverage
We maintain active servers across multiple Bay Area zones — same-day is not a promise made from one office.
| Area | Same-Day Available | Best Cutoff |
|---|---|---|
| Richmond & West Contra Costa | Yes — daily | 2 PM |
| Oakland & Alameda County | Yes — daily | 2 PM |
| San Francisco | Yes — daily | 2 PM |
| Concord / Martinez / Walnut Creek | Yes — most days | Noon preferred |
| Marin County | Yes — scheduled same-day | Noon preferred |
Same-Day Service Still Meets California Court Standards
Speed doesn't mean shortcuts. Every same-day serve complies with California Code of Civil Procedure:
- CCP §415.10 — Personal service; preferred and fastest to complete
- CCP §415.20 — Substituted service when personal service is not possible after diligent effort
- CCP §413.10 — Jurisdiction requirements observed on every serve
For TROs and emergency orders, we prioritize personal service under CCP §415.10 to ensure the court record is unassailable.
Bay Area Court Filing Deadlines — Why the 2 PM Cutoff Exists
Same-day service only matters if it lands before your courthouse closes for the day. Every Bay Area court has a hard document acceptance cutoff. Our 2 PM dispatch window is calibrated to these deadlines — including travel time, attempt time, and documentation.
| Courthouse | Address | Civil Filing Cutoff |
|---|---|---|
| Alameda County — Wiley Manuel (Oakland) | 661 Washington St, Oakland, CA 94607 | 4:30 PM |
| SF Superior Court — Civic Center | 400 McAllister St, San Francisco, CA 94102 | 4:00 PM |
| Contra Costa — Main (Martinez) | 725 Court Street, Martinez, CA 94553 | 4:00 PM |
| Contra Costa — Richmond Branch | 1025 Escobar St, Richmond, CA 94801 | 4:00 PM |
| Marin County Superior Court | 3501 Civic Center Dr, San Rafael, CA 94903 | 4:00 PM |
SF and Marin have earlier effective deadlines because of cross-bay travel time. A 2 PM SF dispatch via the Bay Bridge in afternoon traffic leaves a thin margin. We flag this at intake — if your SF or Marin matter requires same-day filing, submit before noon. Always verify current court hours directly before your deadline day.
Bay Area Same-Day Dispatch — Zone-by-Zone Realities
The Bay Area is not one market — it's five distinct logistics zones, each with constraints that affect what "same-day" actually means in practice.
Oakland & Alameda County
Our fastest same-day zone. Oakland dispatches typically resolve within 2–4 hours of confirmation. Port of Oakland workers, night-shift employees in East Oakland, Fruitvale, and the Coliseum corridor often require staggered attempt windows — we plan around realistic schedules, not 9-to-5 assumptions. Addresses on Alameda Island require routing via the Posey Tube, Webster Tube, or Bay Farm Island Bridge — add 20–30 minutes to standard Oakland estimates. Neighborhood coverage includes West Oakland, Fruitvale, Temescal, Lake Merritt, Rockridge, Laurel, Elmhurst, and East Oakland to the Coliseum District.
San Francisco
SF dispatches cross the Bay Bridge. Non-peak: 30–45 minutes from Oakland. Afternoon windows after 3 PM can extend to 60+ minutes in bridge approach congestion — same-day SF requests received after 1 PM should confirm timeline expectations before we dispatch. Dense residential in the Tenderloin and Mission and high-rise buildings in SoMa and the Financial District require building access coordination that adds time. SF same-day covers all neighborhoods: Mission, SoMa, Tenderloin, Civic Center, Sunset, Richmond District, Castro, Noe Valley, and Bayview-Hunters Point.
Marin County
Marin dispatches cross via the Richmond-San Rafael Bridge — submit by noon for same-day certainty. Tiburon and Sausalito are peninsula tips with limited exit routes; Fairfax, San Anselmo, and Lagunitas involve narrow mountain roads. These add dispatch time that doesn't exist for flat urban routes. Novato (North Marin) is the farthest point — call to confirm morning submission is required for Novato same-day requests.
Contra Costa County (East)
Concord, Walnut Creek, and Martinez same-day requests should arrive by noon for best results. East County — Antioch, Brentwood, Pittsburg — is possible same-day but requires morning submission and confirmation before we commit. We do not promise East County same-day without explicit intake verification.
Frequently Asked Questions — Same-Day Process Serving
What is the cutoff for same-day service?
Call before 2 PM for same-day dispatch across our core Bay Area markets. We can often accommodate later calls — always worth asking. Don't assume it's too late until you call.
Does same-day cost more?
Yes — same-day and rush service carry an urgency fee on top of the base rate. We quote the full price before dispatching. No billing surprises.
What documents can be served same-day?
Summons and complaints, subpoenas, TROs, eviction notices, family law documents, small claims summons, deposition notices — any California legal document requiring formal service of process.
What if the defendant isn't home on the first attempt?
We re-attempt the same evening when logistics allow. You're notified immediately after each attempt with GPS-timestamped documentation ready for court use.
Can I get proof of service the same day?
Yes. Digital proof of service is delivered within hours of completed service — court-formatted and ready to file.
Is same-day available in San Francisco and Marin County?
Yes. Marin same-day requests should be submitted by noon given cross-bay travel via the Richmond-San Rafael Bridge. SF same-day dispatches daily with a 2 PM cutoff.
